Illinois now requires locksmith licensing, I believe, so the answer is probably "not without that licencse." But I Am Not A Lawyer, nor do I reside in that state. It should also be noted that in some parts of the country there are CITY ordinances which affect this.

The easiest way to get a reliable answer is to contact the information desk at your local police office or courthouse. (NOT the emergency number; you can be fined for misusing that!) If you're embarrassed, tell them you're researching for a short story you hope to publish, and this may affect whether your plot works or not.

Note that even where lockpicks are legal in your area, if you are caught carrying them in the vicinity of a crime you can, and probably will, be charged with carrying burglarous implements.  But that can be true of other tools as well.
