To the best of my knowledge one does not have to resort to "legal
action" until the very very bitter end. Usually an "official notice" of
a "cease and desist" is suffecient to show that the copyright holder is
enforcing their rights. However, if the violator continues to violate
the copyright, one may have to resort to legal action to prevent them
from this violation.
