"Fair distribution" has no legal meaning. You may be thinking of "fair
use," which does not include for-profit publishing of other people's
work.

Of course, what is the meaning of a restrictive copyright, given that
one is, as part of the publication process, saying that anyone can
obtain copies for free (for a Gopher/FTP/WWW site) or putting it into
a for-free worldwide distribution system?
We may wind up with a situation where that the publisher is clearly
violating a copyright, but the damages amount to $zero. In which case
everyone is happy (:-).
