I have some personal experience with this. I am principal author of the
free IJG JPEG code, which is available on several Walnut Creek CDs.
(While I have not checked personally, their Simtel collection would
certainly have it, and probably several others.) Walnut Creek has
never contacted me about it.

As a counter example, consider Rich Morin's "Prime Time Freeware" outfit,
which is engaged in much the same business. The IJG code is included on
PTF's Freeware for Unix CD series. This started quite some time ago, so I
don't recall all the details, but I'm pretty certain that PTF contacted me
to tell me about it, get my permission, and offer me a free copy of the
CD. They have faithfully sent me a copy of each new edition of the CD
whenever a new release of the IJG code was included on it. I certainly
would not have found out about it if PTF had *not* contacted me, so theirs
was the first move.

PTF is a much smaller outfit than Walnut Creek, but they don't seem to be
going broke from being courteous to authors.
