i am married to an illegal Mexican, we are in the process of getting a divorce. he is trying to get full custody of our daughter. is that possible?

He has no status in the u.s.he has no right to the child even if he is on the birth papers,you have to file a I-130 to ask for him,his goverment has to give him permission to come back over until then he has no rights,he would have to go back home first

I'm married to a mexican that is here Illegal but we have been seperated for now 10 years and i have not seen him that long not knowing how i can trace him down.because i would like to get a divorce from him and start a new life.but since he is illegal from mexico do i have to go through all divorce papers and court we have nothing shared together nothing i want from him but divorce only how do i get this done .....
