My OPT expired September 14,2006 .My company filed my H1B on April 5,2006, and I got a query on July 21,2006. My employer responded the query after my OPT expired. I checked my status from INS web site, and I saw the following note:

“On September 22, 2006, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case.”


My question is if my H1B is not approved before November 14,2006 which is the end of my 60 days grace period, what is my legal status? Am I going to be out of status or can I still stay in the US until USCIS’s final decision on my H1B case.

I deeply appreciate your help on this matter.
