I have a question my husband has a deportation case, I am married to him and have a son with him.  I am a American citizen and the petition submitted by his attorney was denied because they didn't believe the marriage is real.  

The case is now with the 7th circuit courts and we now have a new attorney.  My husbands old attorney didn't advises us that he had received a letter stating that  my husband was to turn himself in to get sent back to Mexico.  Because his old attorney did not work with the seventh judicial court system we had to get a new a attorney who then  filed a stay of deportation which was temporarily granted.  Now we receive a letter from the 7th circuit stating that my husband has to respond back to the respondents Motion to Dismiss and Opposition to motion stay removal.

His new attorney has told us that he will be sending a letter to the 7th Circuit with the argument that my husband never received notice that he had to surrender himself.  The letter went to his old attorney who never forwarded it to us.  

I am now terrified of the outcome and am worried that the 7th circuit will now just issue a new letter with a new date stating he is deported.  Would it help that I sent a letter to the respondent from the 7th Circuit courts pleading for my husband not to get deported?  What do I do, I can't sit back and have my husband taken away for crime he did his time for already and for case that is nearly 15 years old.
