I am a physician who completed residency on a J1 visa. I subsequently obtained a J1 waiver and am currently employed in a medically underserved area under the Conrad state 30 program on a H1-B visa. I have been working on a H1-B visa for 8 months. I have a 3 year obligation to serve the the medically underserved area. My employer would like to sponsor a green card for me. How soon can I apply for my Green Card - ie do I need to wait till my entire 3 year obligation to work in a underserved area is completed? Is the labor certification process different in my case as I have already proved to INS that my employer was unable to hire a US citizen during my J1 waiver process? Is the application process for a Green card identical to other persons with a H1-B Visa or is it different due to my J1 waiver status?
