does a non-immigrant who is out of status needs a lawyer to file the documents needed to become a permanent resident if married to a U.S. citizen?

I CAME IN USA IN MAY 2001 WITH H4 VISA AND MY HUSBAND WITH H1 VISA WHICH EXPIRED IN SEPTEMBER 2003. BEFORE OUR VISA EXPIRED, IN AUGUST 2002,I APPLIED FOR GREEN CARD BY EMPLOYMENT-UNSKILLED WORKER-AND I AM STILL WAITING FOR NEWS FROM LABOR DEPARTMENT, IT IS BEEN 2 YEARS AND 5 MONTHS NOW AND WE ARE DESPERATE,BECAUSE WE BECAME UNDOCUMENTED ALIENS NOW.WE DO NOT HAVE RELATIVES HERE. OUR QUESTION IS: THERE ARE ANY CHANCES AT ALL FOR US TO BECOME PERMANENT RESIDENTS SOME DAY? WHAT IF WE WIN DV-LOTTERY VISA? WILL THE IMMIGRATION PROCESS OUR FILE HERE IF WE ARE OUT OF STATUS?  PLEASE HELP! THANK YOU!
