Charlie... First, you can call INS and ask them, dial 1-800-5551212 and ask for the toll-free number for Immigration and Naturalization Service. I think she will have to return to her home country, you will have to apply for a J-1 fiance visa, then you can bring her over here and you have 90 days to marry her. After you are married to her you apply to change her status. One of the requirements for this procedure is that you agree to support her for 10 years, even if you divorce. Also you must pledge your income/assets to the gov'tto this end. The request for a fiance visa is nothing but 130$... if you marry her with an expired visa the fee for this form is $1000 and they do NOT have to grant your petition. Either of these choices takes about 6 months. Alternately, you can marry her and she can return to her home country, and you can go to her country. Together with your wife you make a trip to the American Consulate in her city/country and you make your request to bring her to USA there. The fee is about $130. If they grant your request it takes 10 or fewer weeks. From me to you: do NOT waste your time/money on an immigration lawyer. Indeed the going rate is $2,500 and these forms are all EASY, and they are FREE, and INS is nice and will help you. I am marrying a foreigner myself in three weeks and this advice comes from INS through me to you. Good Luck!

My boss, who is a gay man, has asked me to assist him in arranging for a marriage so that he can obtain a British passport. His problem has to do with his Israeli passport: there are countries where he cannot travel and there are airlines that do not welcome him � all because he is an Israeli citizen. I am a 20 year old american girl and i am looking into getting married with a man from chile. I have never been married before and it seems like there are just so many things to think about, especially because he is a foreigner. I am afraid that i will not be prepared for everything that will come my way as a result of this marriage. i need some advice and possibly help with the legalities of a marriage of this kind. I don't even know where to start! i want to make sure that all of my bases are covered going into this (as far as prenuptials and things like that) but as i stated before i've never been married and the whole thing is complicated and confusing. I wanted to know what can my fiance and I do to get married. He lives in England and I live here in the States. He is an african who was raised in Germany, but lives and work in England. We love each other very much but we don't know what to do as far as getting married. I can go to England anytime to visit him but as far as him coming here I know he needs a visa. It seems it is easy for americans to travel into any country but for anyone to come to my country, our government makes it hard for them which I totally understand due to the 9/11 tradegy, I don't blame them at all. I wonder will it be easier to move to England and live there with my fiance rather he living here. I love him very much. Does anyone have any suggestion or experience in this subject. Thanks, Terri

I have a friend who is in USA for last 17 yrs. She married to USA green card holder in back home in court. He been living in USA for a long time and had British citizenship. When his wife came to USA in tourist visa as per his recommondation as he said it will take two yrs to get her immigration papers in India. So she came here and her husband didn't show up at the airport and she found out he is living with another American woman since six month and six month after her marriege as she waited for one yr to get here. As per his promise she found out he never applied for her green card and then he married to that Amerian woman beign married to my friend and committed bigamy. Her community balck balled her name all over, beign her hsuband fault, as he was rich and had many businesses and knew that community for a long time and had power. She file dfor a divorced and her Att. didnt' represent her 100% and her ex transffer all his businesses on his fmaily and woman's name and lied in a deposition. She came out without anything and no green card. Few yrs latter she heard about VAWA self petetion which have condition and two yrs limit and she was not aware of it as she was isolated form every one and not knowing any Govt. program and help, she is still undocumented till today. She was going ot get marrt to anothe rman form anothe rcountry and he assulted her physically and now shemet another American man who is assaulting her psychologically and mentally and thretening her to deport her as her ex did. She applied under 1981 amnesty and was expented till 2003 and then applied under VAWA and Labor certification in 2001 and which was denied as her Att. was very greedy and file dfor a motion. She never beento her country all those 17 yrs and her parent passed away and she i shome sick and can't carry on this misery for a long time. She can't work legally and all immigratn Asian businessmen taking advantage of her not paying wages or paying less and sexually harrassing her and slanfering her name all over if she file charge to Labor or EEOC. If anyone have any remedy to solve this issue pl.le tme know, as it is unhuman what been going on fo ra long time. First of all her husband was stollenby White woman not even that shegot all her property and friend came out with nothing. This is not crossing border or mexican issue, as if anyone cross border same American have problem but if they steal someone else husband and distroy anyonce life then they dont' have any problem with that. WHat a joke!

I am freaking out myself right now. I am an American Citizen, born this way. I have been married to a Filipina for the last year. We have a newborn only 4 days old. I am only 27 and my wife is the same, but because the birth was a C-Section, I am completely broke. Although she did not want to in the first place, things have now changed, since I have little cash left ($60), I want to return to the States and bring my wife and child. The baby is easy, just a small fee in front of the consulate and she is American, but my wife is the hard one. Is there anyway to speed up the immigration process under extenuating circumstances such as my current "financial duress". My first priority is my baby, no matter what I have to do. Marry her first and then hire an immigration attorney.In California attorney's one-time fee for handling such a matter goes around $2500.

Hi, I married American citizen last year, and am still living in my home country for a little while cos of work obligations. I do agree with Lilly that an Immigration Lawyer's gonna cost u a packet... and he's not in charge of your application. You get the forms for FREE online or from an INS office. Call them if u have doubts. I have one question tho: we applied for immigration last year, is there any way to check on the status or processing of this application? How have others in similar situations handled it? Thank you. yd

Hello!! I hired an online immigration lawyer... and its so easy and was well worth the cost...check out infovisanow.com I had k1 visas and now we are married.. we ended up marrying in his country so now we are getting the k3 visa.....and the cost was 700.00, so it was worth it to me, becuz i did not trust the consulate...in his country usa is easy but some consulates will give you a hard time....regardless of the visa approval....for the paper you need to marry...its the capacity of marriage...you can get it from an american consulate if you are aborad.......or from here....it just a paper stating you are single and free to marry.....

I think there is something called advance petition that would allow travel while documents are in process. I have a question for someone. I'm US citizen considering fiance visa. If the foreign fiance and I do not marry and she refuses to return to her home country am I under any obligation to report this to BCIS (INS)and if so how should that be done. Thank you, Mike

Hello, I have an H1B Visa and got married to a US Citizen. I applied through her for a Green by applying for I485 and I30. I got My Work permit for a year. What should I do, can I change My current Employer who sponsors for My H1B Visa and join a new Employer or should I wait for My Green card. All Suggestions can be sent to Me. Thanks.
