Yeah, I agree with that. They are really the people responsible for
the site, and if the author in question actual starts some kind of
legal thing, they are the people in trouble.

Morally and Ethically, I think you're on solid ground; i.e. it doesn't
seem to me that the author has much of a point here. But then, I'm
no expert.
