RE: The tariff classification of wooden valet stand from China.

Dear Mr. Spoto:

In your letter dated April 30, 2008, on behalf of Polyconcept USA, you requested a tariff classification ruling.

Description and a sample, which will be returned as requested, have been submitted of a wooded valet stand Style number VL-236. A compositional breakdown provided shows the valet to be composed of 85% maple wood, 10% metal and 5% other. The valet functions as a rack and hanger to hang clothing overnight in a sleeping area and is designed to stand on the floor.

The applicable subheading for the wooden valet stand will be 9403.50.9080, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Other furniture and parts thereof: Wooden furniture of a kind used in the bedroom: Other: Other, Other”. The rate of duty will be free.

The merchandise in question may be subject to antidumping duties or countervailing duties.
