RE: The tariff classification of two pairs of women’s woven trousers from India.

Dear Ms. Singh:

In your letter dated March 6, 2008, you requested a tariff classification ruling.

The submitted samples are described as follows:

Style #13002 – A pair of women’s pants constructed from 100% viscose woven fabric. The garment has an all-over printed design and features an elasticized waistband with a drawstring, and hemmed leg openings.

Style #66026 – A pair of women’s pants constructed from 100% cotton woven seersucker fabric. The garment features a flat waistband, a front zipper with a two-button closure that fastens right over left, two front pockets, and hemmed leg openings.

We are returning your samples as you requested.

The applicable subheading for the pants, Style #66026, will be 6204.62.4021, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear), trousers bib and brace overalls, breeches and shorts, of cotton, other, other, women’s trousers and breeches, other. The rate of duty will be 16.6% ad valorem.

The applicable subheading for the pants, Style #13002 will be 6204.69.2510, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ trousers, bib and brace overalls, breeches and shorts (other than swimwear), trousers bib and brace overalls, breeches and shorts, of artificial fibers, other, trousers and breeches, women’s. The rate of duty will be 28.6% ad valorem.

The pants, Style 13002, fall within textile category 648. The pants, Style 66026 fall within textile category 348. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
