RE: The tariff classification of women’s wearing apparel from India

Dear Ms. Marino:

In your letter dated April 15, 2008, you requested a classification ruling on behalf of Seeler Inc. The submitted samples will be returned to you as requested.

Style 14265 is a woman’s blouse constructed from 100 percent polyester knit fabric. The blouse features a V-neckline, long sleeves and a full front opening secured by six buttons. The front panels are embellished with embroidery and beading.

Style 21076 is a woman’s upper body garment constructed from 100 percent cotton woven fabric. The garment features a shaped front neckline, adjustable spaghetti shoulder straps, a full front opening secured by eleven button and loop closures, an appliqué and an embroidered design of the right upper front panel. The top edge and bottom have a ruffled eyelet trim. The top back edge is cut straight across from side seam to side seam.

Style 16062 is a woman’s cardigan constructed from 100 percent polyester knitted mesh fabric with embroidered floral designs. The outer surface of the garment measures more than 9 stitches per 2 centimeters in the direction that the stitches were formed. The cardigan features a drawstring hood, long raglan sleeves with drawstring cuffs, a full front opening zippered opening and a drawstring bottom.

Style S0814167A is a woman’s blouse constructed from 100 percent viscose woven fabric. The pullover blouse features elbow length sleeves, a round neckline, a self-fabric tie belt and a hemmed bottom.

The applicable subheading for style 14265 will be 6106.20.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses and shirts, knitted or crocheted: of man-made fibers: other: women’s. The duty rate will be 32 percent ad valorem.

The applicable subheading for style 21076 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of cotton: other. The duty rate will be 8.1 percent ad valorem.

The applicable subheading for style 16062 will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: other: women’s or girls’: other. The duty rate will be 32 percent ad valorem.

The applicable subheading for style S0814167A will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women’s. The duty rate will be 26.9 percent ad valorem.

Style 14265 falls within textile category 639; style 21076 falls within textile category designation 359; style 16062 falls within textile category designation 639; style S0814167A falls within textile category designation 641.
