RE: The tariff classification of woman’s pajama bottoms from the Philippines

Dear Ms. Kessler:

In your letter dated March 31, 2008, you requested a classification ruling. The submitted samples will be returned to you as requested.

Item #057-0961 is a woman’s pajama bottom constructed from 100 percent cotton flannel woven fabric. The garment features an elasticized drawstring waistband long hemmed legs.

Item #057-0959 is a woman’s pajama bottom constructed from 100 percent cotton woven fabric. The garment features an elasticized drawstring waist and capri length legs.

Based upon the information supplied and the appearance of the garments, they are considered to be sleepwear items.

The applicable subheading for both items will be 6208.91.3010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ singlets and other undershirts, slips, petticoats, briefs, panties, nightdresses, pajamas, negligees, bathrobes, dressing gowns and similar articles: other: of cotton: other. The duty rate will be 11.2 percent ad valorem.

Both items fall within textile category 352. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
