RE: The tariff classification of a woman’s knit garment from Cambodia

Dear Ms. Kessler:

In your letter dated April 2, 2008 you requested a tariff classification ruling. We are returning your sample as per your request.

The submitted sample, style 059-0721, is a cut and sewn cardigan constructed from 100% cotton knit fabric whose outer surface measures more than 9 stitches per 2 centimeters in the direction in which the stitches are formed. The garment features a hood with a woven drawstring, a full front opening with a zippered closure, long sleeves with self-fabric banded cuffs, kangaroo type pockets on the front panels and a self-fabric banded garment bottom.

The applicable subheading for style 059-0721 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: Women’s: other. The rate of duty will be 16.5%.

Style 059-0721 falls within textile category designation 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
