RE: The tariff classification of an adult costume from China.

Dear Ms. Shang:

In your letter dated April 1, 2008 you requested a classification ruling. The sample which you submitted is being returned as requested.

The submitted sample Style HCC102 Hustler Troop 74 Costume consists of a top and bottom which you identify as a skirt made of woven 100% cotton fabric. The midriff top has short sleeves, collar, faux flap breast pockets, an attached scarf and a full front opening at ties at the front. The very short bottom garment has flap pockets at the sides, faux snap pockets at the back and elasticized waistband with a zipper and snap.

The applicable subheading for the Hustler Troop 74 Costume, Style HCC102 will be 6211.42.0081, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Track suits, ski-suits and swimwear; other garments: Other garments, Women’s or girls’: Of cotton, Other." The duty rate will be 8.1% ad valorem. The textile category designation is 359.
