RE: The tariff classification of an ornament from China

Dear Mr. Crago:

In your letter dated March 25, 2008, you requested a tariff classification ruling. The sample which you submitted is being retained by this office.

The merchandise under consideration is called the Harvest Vine Weaving Rooster, item number A076GA01102. It is a decorative ornament made of iron wire and grapevine woven in the shape of a rooster. It measures approximately 12.5 inches high by 12 inches long by 5 inches wide. The iron wire comprises 80 percent of the weight and 65 percent of the value of the article.

The applicable subheading for the Harvest Vine Rooster will be 8306.29.0000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for bells, gongs, and the like, nonelectric, of base metalstatuettes and other ornaments, and parts thereof, other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
