RE: The tariff classification of a rug from India

Dear Ms. Seveik:

In your letter dated March 21, 2008 you requested a classification ruling.

The submitted sample, identified as SKU 2284510, is a hand-woven rug. It is stated to be made from 90 percent cotton and 10 percent rayon yarns. The ends of the rug hemmed while the sides are selvage. The rug measures approximately 20 x 30 inches. It features chenille and other yarns in the weft.

The applicable subheading for the rug will be 5702.49.1020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for carpets and other textile floor coverings, woven, not tufted or flocked, whether or not made up, including "Kelem", "Schumacks", "Karamanie" and similar hand-woven rugs: other, of pile construction, made up: of other textile materials: of cotton... not made on a power-driven loom. The rate of duty will be Free.

The rug falls within textile category 369. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
