RE: The tariff classification of stroller parts from Poland and Germany

Dear Ms. Dawson,

In your letter dated March 10, 2008, you requested a tariff classification ruling.

The items under consideration are two (2) stroller parts; these parts, as a complete assembly, have already been the subject of a previous Binding Ruling - N019744. You state in your Ruling Request that these parts are now being imported as separate components and assembled in the United States.

The first part has been identified as a Seat Frame. The Seat Frame is rectangular and is constructed of aluminum, plastic and steel hardware; it measures approximately 18 inches high, 24 inches long and 13 ½ inches wide.

The second part has been identified as Softgoods. The Softgoods consist of a folding canopy and padded insert, both covered with 100% polyester, which connect to the Seat Frame. The canopy is equipped with a plastic window which is covered with a zipper and hook and loop flap; the interior of the canopy contains mesh netting. The padded insert is designed to fit inside the Seat Frame and breaks down into three panels connected with zippers. There is a buttoned strap at the bottom and on the sides to allow the insert to be connected to the frame. The canopy measures approximately 18 inches high, 22 inches deep and 15 inches wide. The padded insert measures 31 inches in height and 31 inches in width.

The applicable classification subheading for the Seat Frame and the Softgoods will be 8715.00.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Baby carriages (including strollers) and parts thereof: Parts”. The rate of duty will be 4.4%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
