RE: The tariff classification of earthenware bowls from China.

Dear Ms. Oliver:

In your letter dated February 17, 2008 you requested a tariff classification ruling.

You submitted three samples of earthenware bowls. You indicated that the bowls are intended to be used as standard dinnerware bowls. Your samples will be returned as requested.

The submitted samples are described as follows:

Item number 08HA130 is an acorn shaped and colored bowl, measuring approximately 1 ¾” H x 5 5/8” W x 7 1/8” L.

Item number 10-5956 is a pumpkin shaped and colored bowl, measuring approximately 2 ¾” H x 6 3/8” W x 6 ¾” L.

Item number 08HAR117GN is a leaf shaped and colored bowl, measuring approximately 2 ¾” H x 6 ½” W x 8” L. The bowl will be available in three colors.

The applicable subheading for the earthenware bowls, item numbers 08HA130, 10-5956, and 08HAR117GN, will be 6912.00.4810, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Ceramic tableware, kitchenware, other household articles and toilet articles, other than of porcelain or china: Tableware and kitchenware: Other: Other: Other: Other, Suitable for food or drink contact.” The rate of duty will be 9.8% ad valorem.
