RE: The tariff classification of two women’s blouses from Indonesia

Dear Ms. Wires:

In your letter dated March 17, 2008 you requested a classification ruling.

Style 231496 is a woman’s blouse constructed of 55 percent cotton and 45 percent modal knit fabric. The garment extends below the waist. It features a full front opening with a six button closure, a V neckline in front, short hemmed sleeves and a hemmed bottom. In the back the garment reaches the nape of the neck. The garment has at least 10 or more stitches per linear centimeter measured in both directions.

Style 231497 is a woman’s blouse constructed of 55 percent cotton and 45 percent modal knit fabric. The sleeveless garment extends below the waist. It features a full front opening with a six button closure, a V neckline in front and a hemmed bottom. In the back the garment reaches the nape of the neck. The garment has at least 10 or more stitches per linear centimeter measured in both directions.

You suggest classification under 6110.20.2079 as a cardigan. Based upon the stitch count, coverage and styling the garments are more specifically provided for as a blouse under 6106.

The applicable subheading for both styles will be 6106.10.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for Women’s or girls’ blouses and shirts, knitted or crocheted: Of cotton: Women’s. The duty rate will be 19.7% ad valorem.

Both styles fall within textile category 339.
