RE: The tariff classification of dress from China.

Dear Mr. Harris:

In your letter dated February 27, 2008, you requested a classification ruling. The sample which you submitted is being returned as requested.

You state that the submitted sample Style 089 is used for dance recitals. The dance recital costume consists of a dress, hat and gloves. The garment is made of knit 83% nylon/17% spandex fabric. The sleeveless trapeze- style dress has a large buckle at the front and two large pockets below the waist. At the back there is a plastic hook closure. The dance recital costume will be packaged for retail sale in a PVC garment bag with an adhesive label affixed to the front.

           General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods "shall be classified as if they consisted of the material or component which gives them their essential character." In this case, the dress imparts the essential character of the sets.              

      The applicable subheading for the Style 089 will be 6104.43.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women’s or girls' suits, ensembles, suit-type jackets, blazers, dresses, skirtsknitted or crocheted, Dresses, Of synthetic fibers, Other, Girls'." The rate of duty will be 16% ad valorem. The textile category designation is 636.
