RE: The tariff classification of a duffle bag with wheels from China

Dear Ms. Gauthier:

In your letter dated February 27, 2008 on behalf of CVS Pharmacy, you requested a classification ruling. The sample which you submitted is being returned as requested.

Style 453347 is a duffle bag with wheels designed to provide storage, protection and portability for clothing and other personal effects during travel. It is manufactured with an exterior surface of polyester textile material. It has a large interior compartment with a mesh zippered pocket. Beneath the main compartment there is another storage compartment with two adjustable webbed straps to hold clothing or personal effects in place. Both compartments are secured with zipper closures. The front exterior of the bag has three zippered pockets, one for shoe storage. The bag can be carried by means of double carrying handles, or pulled by the retractable handle. It measures approximately 29” (W) x 16” (H) x 15” (D).

The applicable subheading for the duffle bag will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The rate of duty will be 17.6 percent ad valorem.

HTSUS 4202.92.3031 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
