RE: The tariff classification of a men’s knit pullover garment from Vietnam.

Dear Ms. Helm:

In your letter dated February 13, 2008, you requested a tariff classification ruling. As requested, your sample will be returned.

Style G3023 is a men’s pullover garment constructed from 100% cotton, interlock knit fabric that measures 30 stitches per two centimeters counted in the horizontal direction. Style G3023 is cut and sewn and has a mock turtleneck collar; a partial front opening with a zippered closure; long, hemmed sleeves; a zippered pocket on the left sleeve; side entry pockets below the waist; a sweat patch at the rear neckline; an embroidered logo on the upper back panel; and a straight, hemmed bottom.

The applicable subheading for Style G3023 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The duty rate is 16.5% ad valorem.

Style G3023 falls within textile category designation 338. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
