RE: The tariff classification of a woman’s cardigan from India.

Dear Mr. Hoffacker:

In your letter dated February 19, 2008 you requested a classification ruling on behalf of your client Broder Brothers DBA Alpha Shirt Company. As requested, your sample is being returned to you.

The submitted sample, style CH900W, is a woman’s “Chestnut Hill” label cardigan that is constructed from 100% knit microfiber polyester fabric that is napped on both the inside and outside surfaces. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment extends to the waist. The cardigan features a stand-up collar, a full front zippered opening that extends to the top of the collar, long loose fitting capped sleeves, a front horizontal pocket with a zippered closure at the waist, and a loose fitting capped bottom.

You asserted classification as a jacket, however, the loose fitting bottom of the garment would not provide sufficient protection against the elements to warrant classification as such. The garment is properly classified as a cardigan of 6110, HTSUS.

The applicable subheading for the cardigan will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweatersand similar articles, knitted: of man-made fibers: other: other: other: Women’s or girls’: other. The duty rate will be 32% ad valorem.

The cardigan falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
