RE: The tariff classification of style number’s 110052 and 110052H, Child Sultry Sorceress, from China, Taiwan, India and Vietnam

Dear Ms. Tsiavos:

In your letter dated February 11, 2008, you requested a tariff classification ruling.

Style number’s 110052 and 110052H, Child Sultry Sorceress, are two styles of a flimsy costume comprised of a long sleeve knit polyester hooded black dress. The costume is overwhelmingly flimsy, with a loose overlock stitched neck and seams, a flimsy hook and loop tab closure and loose overlock stitched or raw edges at the arms, bottom closure and hood opening.

The applicable subheading for style number’s 110052 and 110052H, Child Sultry Sorceress, will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be Free.
