RE: The tariff classification of Christmas Stocking Hangers (item #A075EA00437) from China

Dear Mr. Crago:

In your letter dated February 8, 2008, you requested a tariff classification ruling.

You submitted a sample of the reindeer and snowflake Christmas Stocking Hangers (item #A075EA00437), which is being returned upon your request.

The Christmas Stocking Hangers (item #A075EA00437) are imported in two designs, reindeer and snowflake, and measure approximately 7” in height x 3 7/8” in width x 5 1/8” in length. The stocking hangers are made of iron and acrylic.

The reindeer and snowflake stocking hanger have hooks placed directly under the object for hanging Christmas stockings. The Christmas Stocking Hanger is a practical alternative for homeowners who do not have a mantel to hang Christmas stockings during the Christmas holiday. Therefore, the Christmas Stocking Hangers functions as an accessory to a Christmas stocking, which is an article traditionally used at Christmas festivities.

The applicable subheading for the Christmas Stocking Hangers (item #A075EA00437) will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be Free.
