RE: The tariff classification of a woman’s blouse from Hong Kong. Correction to Ruling Number N021911

Dear Ms. Iacobello:

This replaces Ruling Number N021911, dated January 24, 2008, which contained a clerical error. The tariff number stated was incorrect. A complete corrected ruling follows.

Submitted sample, style #9183, is a woman’s blouse constructed from knit and woven fabric. The upper part of the garment is constructed from 60% cotton, 25% nylon and 15% wool knit fabric. The lower part of the garment is constructed from 100% silk woven fabric. The pullover garment is collarless and features a square neckline, ¾ length sleeves, an empire waist and a hemmed bottom.

Neither the knit nor the woven portion provides the essential character of the garment. Therefore, in accordance with General Rules of Interpretation, GRI 3(c), the garment shall be classified under the heading which occurs last in numerical order among those which equally merit consideration. In this case, the heading is 6206, HTS.

The applicable subheading for the style 9183 will be 6206.10.0040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of silk or silk waste: other: containing 70 percent or more by weight of silk or silk waste. The duty rate will be 6.9 percent ad valorem.

Style 9183 falls within textile category 741. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
