RE: The tariff classification of a unisex costume set from Hong Kong.

Dear Mr. Gomez:

In your letter dated January 21, 2008, on behalf of California Costumes, Inc., you requested a classification ruling. The sample which you submitted is being returned as requested.

As per our telephone conversation Style 00305 Demon of War Child and Style 00913 Demon of War Adult are identical to Style 00307 Demon of Pain Child and Style 00914 Demon of Pain Adult with the exception of the color. The costume consists of a flimsy long dress-like garment (robe) and cape made of knit 100% polyester fabric and plastic horns. The dress-like garment has long sleeves with tattered sleeves and a neckline with a hook and loop closure at the back. The cape has an attached hemmed hood and a full front opening and bottom with tattering.

The cape is well made with styling, a finished neck, sturdy seams and hemmed hood.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, the cape imparts the essential character of the set.

The applicable subheading for the Styles 00305, 00913, 00307 and 00914 will be 6114.30.3070, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other garments, knitted or crocheted: Of man-made fibers: Other, Other: Women’s or girls’." The duty rate will be 14.9 percent ad valorem. The textile category designation is 659.
