RE: The tariff classification of a thumb cover from China

Dear Ms. Scott:

In your letter dated January 21, 2008, you requested a tariff classification ruling on behalf of your client, Thumbuster LLC, of Bellevue, Washington.

The submitted sample is identified as “Thumbusters.” The item, which you indicate is constructed of 100% knitted nylon fabric, is L-shaped and measures approximately 5½”W x 4”H when fully opened up. It is worn on the thumb and secured with a hook-and-loop fastener. You indicate that it is recommended for children between the ages of five and twelve who need the reminder to stop sucking or biting as applicable to the individual child. It is not a decorative cover, but rather a functional one.

The applicable subheading for the thumb cover/Thumbuster will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other made up textile articles, other. The rate of duty will be 7% ad valorem.

The sample will be returned as requested.
