RE: The tariff classification of a girl’s top from Hong Kong.

Dear Ms. Braun:

In your letter dated December 28, 2007, you requested a tariff classification ruling. The submitted sample will be returned to you.

The sample, Style H7247 is described as a sweater-knit cardigan. The garment is constructed of cotton jersey fabric that contains less than 9 stitches per 2 centimeters as measured in the direction the stitches were formed. The item features a full front opening with two button neck closure, long sleeves with rib-knit cuffs and rib-knit fabric at the neckline, front opening and bottom. The article has embroidery and appliqué work in the form of flowers. The abbreviated garment is not classified as a sweater because it does not reach the vicinity of the waist. The item will be imported in girls’ sizes 2 to 16.

The applicable subheading for Style H7247 will be 6114.20.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other garments, knitted or crocheted: of cotton, tops, women’s or girls’. The rate of duty will be 10.8 percent ad valorem.

Girl’s cotton knit tops fall within textile category 339. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
