RE: The tariff classification of an adult costume from China.

Dear Ms. Lee:

In your letter received in this office on December 11, 2007, on behalf of Sears Holdings Global Sourcing Ltd., you requested a classification ruling. As requested, the samples will be returned. .
The submitted samples are Style #s W-2326-00 Poodle Girl and W-1743-00 Devil costumes.

The Style# W-2326-00 Poodle Girl costume consists of a dress constructed of knit polyester fabric. The well made dress features a faux lace-up front, attached decorative apron, sturdy waist and seams, and a sewn-on belt.

The applicable subheading for the Style# W-2326-00 Poodle Girl costume will be 6104.43.2010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Women's or girls' suits, ensemblesdresses, skirts, divided skirts, trousersknitted or crocheted: Dresses: Of synthetic fibers, Other, Women’s." The rate of duty will be 16% ad valorem. The textile category designation is 636.

The Style# W-1743-00 Devil costume was classified in ruling N003659, dated December 21, 2006. There is no need to issue another classification ruling.
