RE: The tariff classification of a man’s swim short from Bangladesh.

Dear Ms. Malina:

In your letter dated November 30, 2007, you requested a classification ruling. As requested the sample will be returned.

The submitted sample is a Style #282262 Men’s 6” Snap Front Swim Trunk constructed of 100% nylon fabric. The swim trunk features a 6” inseam, a waistband with back-half elastic though which an inner drawstring is threaded, lightweight polyester mesh support liner, snap waist closure, plastic zip fly with an inner protective flap, two side slash pockets and one rear pocket with drainage, inside coin pocket and side leg vents.

The applicable subheading for the Style #282262 Men’s 6” Snap Front Swim Trunk will be 6211.11.1010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for track suits, ski-suits, and swimwear, other garments: swimwear: men’s or boys’: of man-made fibers, men’s. The duty rate will be 27.8 percent ad valorem.

Style #282262 falls within textile category 659.
