RE: The tariff classification of children’s costumes from China.

Dear Ms. Lee:

In your letter dated November 17, 2007, on behalf of Sears Holdings Global Sourcing Ltd., you requested a classification ruling. As requested, the samples will be returned.

You have submitted five samples. Style G-2279-02 is a children’s Purple Princess Costume Set. The costume consists of a well-made dress constructed of velveteen polyester knit fabric with a contrasting color middle insert made of same material and an approximately three inch inset next to that constructed from polyester woven fabric. The garment also features a underskirt with a hoop bottom. The dress has well-made styling features, a finished neck, finished edges and sewn on embellishments. The set also includes a textile fabric tiara style hair slide.

Style G-2612-00 is a children’s Fairy Princess Costume Set. The costume consists of a well-made dress constructed of velveteen polyester knit fabric with a polyester woven fabric inset down the middle of the dress. The garment also features a polyester knit mesh underskirt and another underskirt with a hoop bottom. The dress has well-made styling features, a finished neck, finished edges and sewn on embellishments. The set also includes textile fabric wings.

Style G-2882-01 is a children’s Pink Princess Costume Set. The costume consists of a well-made dress constructed of woven polyester fabric with a hoop bottom underskirt. The dress has well-made styling features, a finished neck, finished edges and sewn on embellishments. The set also includes a textile fabric hat and textile fabric choker with a hook and loop fastener. Style G-3072-00 is a children’s Red Princess Costume Set. The costume consists of a well-made dress constructed of velveteen polyester knit fabric with middle inset constructed from polyester woven fabric. The garment also features a underskirt with a hoop bottom. The dress has well-made styling features, a finished neck, finished edges and sewn on embellishments. The set also includes a textile fabric tiara style hair slide.

Style G-3073-00 is a children’s Black Vampiress Costume Set. The costume consists of a well-made dress constructed of velveteen polyester knit fabric with a middle inset constructed from polyester woven fabric. The garment also features a underskirt with a hoop bottom. The dress has well-made styling features, a finished neck, finished edges and sewn on embellishments. The set also includes a textile fabric choker with a hook and loop fastener.

General Rule of Interpretation (GRI) 3(b) is applicable when goods are, prima facie, classifiable under two or more headings, and have been put up in sets for retail sale. GRI 3(b) states that the goods “shall be classified as if they consisted of the material or component which gives them their essential character.” In this case, for all styles the dresses impart the essential character of the sets.

The applicable subheading for styles G-2279-02 Purple Princess Costume Set, G-2612-00 Fairy Princess Costume Set, G-3072-00 Red Princess Costume Set and G-3073-00 Black Vampiress Costume Set will be 6104.43.2020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, . . . knitted or crocheted: dresses: of synthetic fibers: other, girl’s. The duty rate will be 16 percent ad valorem. The textile category designation is 636.

The applicable subheading for styles G-2882-01 Pink Princess Costume set will be 6204.43.4040, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ suits, ensembles, suit-type jackets, blazers, dresses, . . . : dresses: of synthetic fibers: other, other: girl’s. The duty rate will be 16 percent ad valorem. The textile category designation is 636.
