RE: The tariff classification of handbags from China or Israel

Dear Mr. Lees:

In your letter dated October 31, 2007, on behalf of Daisy Cook LLC, you requested a classification ruling. The samples which you submitted are being retained by this office.

The sample was submitted without a style number. The item consists of two handbags with shoulder straps that are connected to the other by means of a plastic zipper. Each bag can be used separately on its own. The handbags are constructed of 70% polyester and 30% rayon textile material. They are designed and sized to contain the small personal effects a young girl would carry on a daily basis. The bags each have a single textile lined interior compartment with a zippered wall pocket. Both bags have a flap which folds over the top and secures with a magnet that is hidden under the lining. The front exterior of each bag has two pockets with flaps and hidden magnetic closures. The handbags measure approximately 10” (W) x 8” (H) x 3” (D).

The applicable subheading for the handbags will be 4202.22.8050, Harmonized Tariff Schedule of the United States (HTSUS), which provides for handbags, whether or not with shoulder strap, including those without handles, with outer surface of textile material, other, other, other, of man-made fibers. The duty rate will be 17.6% ad valorem.

HTSUS 4202.22.8050 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
