RE: The tariff classification of plastic vacuum sealed storage bags from China

Dear Mr. Smith:

In your letter dated September 14, 2007 you requested a tariff classification ruling.

The submitted illustration depicts an item identified in your letter as an IKEA DRAGBY vacuum-sealed bag, article number 701-121-60. The illustration of the retail box identifies the item as a Home Storage Space Maker Vacuum Compression Bag. The bag measures 39-3/8 inches in length by 31-1/2 inches in width. It is made of transparent polyethylene (PE) plastic and has a valve and plug made of polyamide (PA) plastic built into the lower part of one side. The bag also has a zip-lock type closure at the bottom.

The bag is designed to store clothes pillows, comforters or other bulk household items. When in use, the items to be stored are placed inside the bag and the bag is then sealed by means of the zip-lock type closure. Once the bag is sealed, a household vacuum cleaner can be used to remove the air through the valve that is located on the side and the valve is then closed by means of the plug. The removal of the air will condense the overall size of the bag with the various articles stored within. This allows for the storage of large household items in relatively smaller areas, thereby saving space. Since the items are stored in a vacuum sealed environment it has the added benefit of providing a dust, mildew, insect and moisture free environment for the items being stored.

The applicable subheading for the IKEA DRAGBY vacuum-sealed bag will be 3924.90.5600, Harmonized Tariff Schedule of the United States (HTSUS), which provides forother household articlesof plastics: other; other. The rate of duty will be 3.4 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
