RE: The tariff classification of tights from China.

Dear Ms. Buford:

In your letter dated August 20, 2007, you requested a classification ruling on behalf of your client, Kayser-Roth Corporation. The sample submitted will be returned.

Style 3461 “Diamond Capri” is a pair of adult tights constructed of 95% nylon and 5% spandex knitted fabric. The footless tights feature an elasticized waistband, a hemmed bottom and decorative diamond designs. You state that the tights measure less than 67 decitex.

The applicable subheading for style 3461 will be 6115.21.0010, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other panty hose and tights: Of synthetic fibers, measuring per single yarn less than 67 decitex, Tights." The rate of duty will be 16 percent ad valorem.

Style 3461 falls within textile category 659. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
