RE: The tariff classification of woman’s cardigan from Indonesia.

Dear Ms. Cali:

In your letter dated August 17, 2007 you requested a classification ruling. You have indicated that Wal-Mart Stores Inc. will be the importer of record when the goods are imported into the United States. As requested, your sample will be returned to you.

The submitted sample, style AW341831, is a woman’s cardigan that is constructed of a 100% polyester mesh knit fabric with 100% polyester fabric trim extending from the collar down both sleeves. The outer surface of the fabric measures more than nine stitches per two centimeters in the direction that the stitches were formed. The garment extends to the waist. The cardigan features a hood, long sleeves with loose fitting self-fabric cuffs, a full front zippered opening, an embroidered appliqué is found on the upper left front panel, two inset pockets at the waist, and a loose fitting self-fabric banded bottom. Style AW341831 lacks tightening at the garment bottom and cuffs, therefore, it is properly classified as a cardigan under 6110, HTSUS.

The applicable subheading for the cardigan will be 6110.30.3059, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: women’s or girls’: other. The duty rate will be 32%.

The cardigan falls within textile category 639. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries.
