RE: The tariff classification of a girl’s garment from China.

Dear Mr. Ryu:

In your dated, August 3, 2007, you requested a tariff classification ruling. As requested, the sample will be returned to you.

Your submitted sample, style 8124-1109 is a girl’s upper body garment constructed from 100% cotton knit fabric. The outer surface of the garment measures between 9 and 18 stitches per two centimeters in the direction in which the stitches are formed. The sleeveless garment features a collar, full frontal opening with four button closure and an adjustable self-tie bottom. The garment also features embroidery with the words South Pole™ on the back yoke, embroidery on the left front with the words “established in 1991” and a stylized SP logo of non textile material. The garment reaches the vicinity of the waist.

The applicable subheading for style 8124-1109 will be 6110.20.2079, Harmonized Tariff Schedule of the United States (HTSUS), which provides for sweaters, pullovers, waistcoats (vests) and similar articles, knitted or crocheted: of cotton, other, other: other: women’s or girls’: other. The rate of duty will be 16.5 percent ad valorem.

Style 8124-1109 falls within textile category 339.
