RE: The tariff classification of a men’s knit pullover garment from India.

Dear Ms. Doolittle:

In your letter dated June 20, 2007, which was received by this office on July 31, 2007, you requested a tariff classification ruling on behalf of Summit Resource Imports. As requested, your sample will be returned.

Style W08825 is a men’s pullover garment constructed from 100% cotton, finely knit jersey fabric that measures 26 stitches per 2 centimeters counted in the horizontal direction. The garment is cut and sewn and features a rib knit crew neckline; long, loose fitting sleeves with rib knit cuffs; a half-moon at the rear neckline; screen printing on the chest, the lower portion of the left front panel and the rear panel; and a straight, hemmed bottom.

The applicable subheading for Style W08825 will be 6110.20.2069, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: other: men's or boys'. The rate of duty is 16.5% ad valorem.

Style W08825 falls within textile category designation 338.
