RE: The tariff classification of a woman’s camisole from China

Dear Ms. Lim:

In your letter dated June 6, 2007 you requested a classification ruling written on behalf of your client, Silver Textile Inc. The submitted sample will be returned.

Style ST-002 is an underwear camisole constructed of lightweight 92% cotton and 8% spandex knit fabric. The camisole is supported on the body by thin elasticized and adjustable shoulder straps. It covers the torso from the top of the bust to below the waist. The garment features side seams, a scalloped V-styled front and lace-like trim along the top and bottom garment edges.

Knit camisoles are provided for in heading 6109, Harmonized Tariff Schedule of the United States (HTSUS), therefore, your suggested classification in heading 6108 is not applicable.

The applicable subheading for the style ST-002 will be 6109.10.0037, Harmonized Tariff Schedule of the United States (HTSUS), which provides for T-shirts, singlets, tank tops and similar articles, knitted or crocheted: of cotton women’s or girls’: underwear. The duty rate will be 16.5 percent ad valorem.

Style ST-002 falls within textile category 352. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information on quota and visa requirements applicable to this merchandise, we suggest you check, close to the time of shipment, the “Textile Status Report for Absolute Quotas” which is available on our web site at www.cbp.gov. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
