RE: The tariff classification of a man’s jacket from China

Dear Ms. Boullet:

In your letter dated June 18, 2007, on behalf of Mountain Hardwear, a wholly owned subsidiary of Columbia Sportswear, you requested a classification ruling.

The sample submitted, style number OM2422, is a man’s hip-length jacket with a shell composed of one layer of a finely knit 100% polyester jersey fabric on the outer surface and one layer of a finely knit 100% polyester tricot fabric on the inner surface, with a polytetrafluoroethylene (PTFE) lamination in between. The polytetrafluoroethylene coating is visible through the inner fabric, qualifying it for classification in HTSUS heading 6113.

The jacket has an integral hood with a drawcord tightening, a full front opening secured by a zipper closure, long sleeves with a banded-type cuff, knit inner storm cuffs with a thumb hole and an elastic binding tightening at the edge, a left chest pocket with a zipper closure, two front pockets with zipper closures at the waist, a double pull side seam zipper opening that extends under each armhole for ventilation and a drawcord tightening through the bottom hem.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6113.00.9025, Harmonized Tariff Schedule of the United States (HTSUS), which provides for garments, made up of knitted or crocheted fabrics of heading 5903, 5906 or 5907: other: coats and jackets: other: men’s or boys’. The duty rate will be 7.1 percent ad valorem.

The jacket falls within textile category 634.
