RE: The tariff classification of a woman’s blouse from China

Dear Ms. Fox:

In your letter dated June 15, 2007, you requested a classification ruling on behalf of Ann Taylor, Inc. Your sample will be returned as requested.

Submitted sample, style #24-208886, is a woman’s blouse constructed from both woven and knit fabric. The woven fabric is composed of 100% silk and the knit fabric is composed of 100% nylon. The garment has a woven underlay and insert with a lace knit overlay to simulate a layered-look. The sleeveless pullover garment is collarless and the woven inner portion features a scooped neckline and spaghetti shoulder straps. The knit outer portion features a v-neckline and approximately two and half inch wide shoulder straps, a side zipper, an empire waist, a full lining and a hemmed bottom. The garment will be imported in petite sizes under style #63-212309.

The applicable subheading for the style 24-208886 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women’s. The duty rate will be 26.9 percent ad valorem.

Duty rates are provided for your convenience and are subject to change. The text of the most recent HTSUS and the accompanying duty rates are provided on World Wide Web at http://www.usitc.gov/tata/hts/.

Style 24-208886 falls within textile category 641. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
