RE: The tariff classification of backpack from China

Dear Ms. Shu:

In your letter dated June 12, 2007, you requested a classification ruling. Your sample will be returned as requested.

The sample is identified as a “Sportsman Tri-Color Sport Backpack,” style 9413. It is constructed with an outer surface of man-made textile fiber material that is coated on the inner side with polyvinyl chloride (PVC) plastic sheeting. The backpack provides the useful functions of storage, protection, organization and portability for provisions and other personal effects during travel. The interior features a large single textile-lined compartment with a zippered pocket on the back wall. The exterior has a zippered pocket on the front and zippered mesh pockets on each side. The top of the backpack is secured by means of a zippered closure. The backpack has adjustable, padded shoulder straps permanently attached at the back. It measures approximately 14.5” (W) x 16.5” (H) x 10.5” (D).

The applicable subheading for the backpack will be 4202.92.3020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, backpacks. The rate of duty will be 17.6 percent ad valorem.

HTSUS 4202.92.3020 falls within textile category 670. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
