RE: The tariff classification of hats from China.

Dear Ms. Hu:

In your letter dated June 13, 2007, you requested a classification ruling. The samples will be returned to you.

Style 9752 is a cap with an outer shell of knit 100% polyester fabric. The cap has earflaps and a peak.

Style 48014 is a ski-style hat made of rib knit 100% cotton fabric.

Style48020 is a ski-style hat made of knit 100% cotton fabric with a knit lining.

Style 9878 is a ski-style hat made of knit 55% cotton/45% acrylic fabric.

 The applicable subheading for the Style 9752 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric...Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659.

 The applicable subheading for Styles 48014, 48020 and 9878, will be 6505.90.1540, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not trimmedOther: Of cotton, flax or both: knitted, Of cotton: Other: Other.” The duty rate will be 7.9% ad valorem. The textile category designation is 359.
