RE: The tariff classification of a men’s sweater vest from Mexico.

Dear Mr. Aives:

In your letter dated June 4, 2007, you requested a tariff classification ruling. As requested, your sample will be returned.

Style TA5000-NV is a men’s sweater vest constructed from 100% acrylic, jersey knit fabric that measures 9 stitches per two centimeters counted in the horizontal direction. The sweater is sleeveless and features a rib knit mitered V-neckline; rib knit edging on the armholes; woven fabric shoulder patches with epaulets; a woven badge patch on the right chest; and a rib knit bottom.

Although you state that you believe the garment is classifiable as a pullover in HTS 6110.30.3053, Style TA5000-NV satisfies the requirements of Chapter 61, Statistical Note 3 as a sweater. Since the knit stitches are formed horizontally across the fabric, the horizontal stitch count is obtained by counting the columns of stitches or wales across the fabric.

The applicable subheading for Style TA5000-NV will be 6110.30.3010, Harmonized Tariff Schedule of the United States, (HTSUS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of man-made fibers: other: other: other: other: sweaters: men’s. The rate of duty is 32% ad valorem.

Style TA5000-NV falls within textile category designation 645. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries.
