RE: The tariff classification of a man’s jacket from Vietnam

Dear Ms. York:

In your letter dated June 4, 2007, on behalf of Target Stores, you requested a classification ruling.

The sample submitted, style number 210688, is a man’s hip-length jacket with a shell composed of a woven 100% cotton twill fabric and a lining composed of a woven 100% cotton fabric in the body and a woven 100% polyester in the sleeves, which are quilted together in a vertical pattern with a nonwoven batting fill in between.

The jacket has a fold-down pointed spread collar, a full front opening secured by six left-over-right, rivet-type button closures, epaulets with a one-button closure on the shoulders and long sleeves that have a gusset fabric insert at the wrist area and a one-button closure on the cuffs. The jacket also has two chest pockets with a one-button flap closure, two front slash pockets at the waist, four inner pockets and a curved bottom hem. Each button features the “Mossimo Denim Est 1987” tradename.

The sample is being returned to you as you have requested.

The applicable subheading for the jacket will be 6201.92.2051, Harmonized Tariff Schedule of the United States (HTSUS), which provides for other men’s anoraks, windbreakers and similar articles: of cotton: other: other: other. The duty rate will be 9.4 percent ad valorem.

The jacket falls within textile category 334. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
