RE: The tariff classification of hats, a headband and face mask from China.

Dear Mr. Ashear:

In your letter dated June 1, 2007, you requested a classification ruling. The samples will be returned to you.

Four samples were submitted with your request.

Style AW47AC109 is a cuff-style hat made of knit polyester fabric.

Style AW47AC107 is a cuff-style hat made of knit acrylic fabric with polyester insulation.

Style AW47AC110 is a knit acrylic headband that is worn for warmth, measures approximately 4 ¼” wide at the front and widening at the back to cover the ears.

Style AW47AC106 is a hood style knit acrylic face mask resembling a balaclava. The face mask has openings for the eyes and nose and covers the top of the head and neck.

All of the above styles will be made in different colors.

The applicable subheading for the Styles AW47AC109, AW47AC107 and AW47AC106 will be 6505.90.6090, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric...Other: Of man-made fibers: knitted or crocheted or made up from knitted or crocheted fabric: not in part of braid, Other: Other: Other." The duty rate will be 20 cents per kilogram plus 7% ad valorem. The textile category designation is 659.

 The applicable subheading for Style AW47AC110 will be 6117.80.8500, Harmonized Tariff Schedule of the United States (HTSUS), which provides for "Other made up accessories, knitted or crocheted; knitted or crocheted parts of garments or of clothing accessories: other accessories: Other: headbands, ponytail holders and similar articles." The duty rate will be 14.6% ad valorem.
