RE: The tariff classification of a woman blouse from China

Dear Mr. Choe:

In your letter dated May 25, 2007, you requested a classification ruling on behalf of Taimex LLC. Your sample will be returned.

Submitted sample, style #0350, is a woman’s blouse constructed from 97% polyester and 3% spandex woven fabric. The pullover garment extends approximately 25 inches from the shoulder to the upper thigh and features a v-wrap neckline, short sleeves, empire waist with a partial belt and buckle in the front, a self-fabric tie in the back and hemmed bottom.

In your letter you state that the sample is a dress. The garment provides insufficient coverage for wear as a dress. The Textile Category Guidelines, CIE 13/88 dated November 23, 1988, describes a dress, in part, as a one-piece garment covering the top of the body and extending to somewhere from below mid-thigh to the feet. It is appropriate for wear without other outer garments. The submitted garment does not extend to the mid thigh. This garment does not provide the requisite coverage to be classified as a dress.

The applicable subheading for the style 0350 will be 6206.40.3030, Harmonized Tariff Schedule of the United States (HTSUS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of man-made fibers: other: other: other: women’s. The duty rate will be 26.9 percent ad valorem.

Style 0350 falls within textile category 641. With the exception of certain products of China, quota/visa requirements are no longer applicable for merchandise which is the product of World Trade Organization (WTO) member countries. The textile category number above applies to merchandise produced in non-WTO member-countries. Quota and visa requirements are the result of international agreements that are subject to frequent renegotiations and changes.
